Terms of Service

1. Accepting these terms

By using AvatarStudio you agree to these Terms of Service. If you do not agree, do not use the service. These terms include the Acceptable-Use Policy, the Privacy Policy, and the Notice & Takedown Policy by reference.

2. The service

AvatarStudio is a web app where you pick a character (a “Sidekick”), pick a dance (a “Move”), and record yourself dancing beside it to produce a short composited video. On supported phones the video is created on your device; where your device cannot do this, the service builds it in the cloud as a mandatory fallback. You can also generate your own custom Sidekicks and Moves, which uses credits. We may add, change, or remove features over time.

3. Eligibility and age

You must meet the minimum age for your country to hold an account. People under 13 may use the service only with verifiable parental consent and with the protections described in the Privacy Policy. People under 16 cannot publish to the public library. We may ask you to confirm your age range at a gate, and we may restrict features based on it.

4. Your account

Accounts are created and secured through Amazon Cognito using your email address. You are responsible for activity on your account and for keeping your sign-in credentials secure. Notify us promptly of any unauthorized use. You can delete your account and the data tied to it from your account settings at any time.

5. Acceptable use

Your use of AvatarStudio is subject to the Acceptable-Use Policy, which prohibits, among other things, using a real person's likeness without rights, infringing intellectual property, content involving minors, and sexual, illegal, hateful, or harassing content, as well as scraping, abuse, and attempts to bypass credits or moderation. Violations can lead to removal of content and termination of your account.

6. Your content and the rights you grant

You keep ownership of the Sidekicks, Moves, and videos you create (“Your Content”). To run the service we need a license: you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content for the purpose of providing AvatarStudio to you, including generating assets through our partners and building your duets (on your device or, as a fallback, in the cloud).

Public library (opt-in). Your Content is private by default. If you choose to publish it — and only after it passes our moderation and human-review gate and you complete the required safety acknowledgements — you additionally grant us and other users a non-exclusive, worldwide, royalty-free license to view, use, share, and remix that content within the public AvatarStudio libraries, subject to our attribution rules. Publishing is opt-in; we never make Your Content public automatically, and publishing does not mean any public use of it is lawful. You can request removal of your public content, though copies others may already hold or have remixed may persist.

You confirm you have all rights needed in anything you create or upload, including any person's likeness, brand, character, or music. We may remove content that violates these terms or the law.

7. AI-generated content

Custom Sidekicks and Moves are produced with generative AI through our partners (for example, Meshy for characters and Move.ai for motion). AI output can be unexpected, inaccurate, or resemble existing people or works; you are responsible for reviewing what you create and for how you use it. We do not guarantee that generated content is unique, accurate, or free of third-party rights, and we make no representation that any output is cleared for any particular use.

8. Credits

Generating a custom Sidekick or Move, and removing a watermark, costs prepaid virtual credits. Browsing the libraries, picking an existing Sidekick and Move, and creating and saving a duet do not cost credits. You buy credits in packs through Stripe (see section 9).

• Credits are a prepaid license to use paid features. They have no cash value, are not money or a stored-value instrument, and cannot be redeemed for cash, transferred, or resold.
• Except where the law requires otherwise or a refund is expressly offered at checkout, purchased credits are non-refundable, and credits spent on a completed generation are not returned.
• If a generation hard-fails on our side, we credit the charge back to your wallet as described in the product.
• Credit prices, pack contents, and the credits-per-action prices may change at any time with notice; changes are not retroactive to credits you already spent.
• We may expire credits or close inactive wallets where permitted by law and disclosed in advance.

9. Payments

Credit-pack payments are processed by Stripe under its terms. We do not store your full card number. You authorize the charge shown at checkout, including applicable taxes. Refunds, where offered, follow the policy shown at checkout and applicable law. Chargebacks or payment disputes may result in suspension of access pending resolution.

10. Likeness and right of publicity

Do not create or upload a real person's likeness without their consent or another legal right. Right-of-publicity and similar laws protect a person's appearance, and there is no automatic safe harbor for those claims. You are solely responsible for the likenesses you use, and you agree to our checks and attestations for any content you submit to the public library.

11. Music and audio

Moves may ship without audio, with audio from a licensed catalog, or you may supply your own audio off-app. Using AvatarStudio does not grant you any rights in any music, recording, or composition. If you add your own audio, you confirm you have the rights to use it. We grant no license to any third-party recording or composition.

12. Disclaimers and limitation of liability

AvatarStudio is provided “as is” and “as available” without warranties of any kind, to the extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, and our total liability is limited as set out in the final terms (the cap is a placeholder pending counsel). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Termination and repeat infringers

You can stop using the service and delete your account at any time. We may suspend or terminate access for violations of these terms or the Acceptable-Use Policy, or as required by law. We terminate the accounts of repeat infringers, as described in our Notice & Takedown Policy. On termination, your prepaid credits are handled as described in section 8 and applicable law.

14. Changes, governing law, and contact

We may update these terms; we will mark the new effective date and, where required, notify you. Continued use after an update means you accept the change. These terms are governed by the laws of [governing-law placeholder — pending counsel], and disputes are subject to the venue and dispute-resolution terms finalized with counsel before launch.
